These Terms of Service (“Terms”) govern your use of the website agrorig.co.uk (“Website”) and any transactions for the sale or supply of used agricultural and construction machinery (“Goods”) by AGRORIG LTD (“we”, “us”, “our”), a company registered in England and Wales under Company No. 16110491 with its registered office at C/O Word Consulting Ltd, Innovation Centre Medway, Maidstone Road, Chatham, Kent, ME5 9FD.

By accessing this Website or entering into any agreement with us for the purchase of Goods, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Website or purchase Goods from us.

These Terms are governed by the laws of England and Wales. If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation.

Enquiries and expressions of interest made through this Website do not constitute a binding contract. A contract for the sale of Goods is formed only when we issue written confirmation of your order (by email or other written means) and, where applicable, a deposit or full payment has been received.

We reserve the right to decline any order at our discretion before a contract is formed. All sales are subject to the specific terms agreed in writing between you and AGRORIG LTD at the time of purchase.

All prices displayed on this Website are indicative and may be shown in various currencies as a guide. The final sale price will be confirmed in writing prior to any binding agreement.

Unless otherwise stated, prices do not include VAT (where applicable), delivery, transport, insurance, import duties, or any other costs associated with the purchase and delivery of Goods.

Payment terms (including any deposit requirements) will be agreed between the parties prior to the formation of a contract. Full payment must be received before the release or dispatch of any Goods unless alternative arrangements have been agreed in writing.

We may offer or facilitate access to third-party financing arrangements (such as hire purchase or leasing) for the purchase of machinery. Any financing is provided by independent third-party finance companies and is subject to their own terms, conditions, and credit approval processes.

AGRORIG LTD does not act as a lender or credit broker. We do not guarantee the approval or availability of any financing arrangement. Any finance agreement is between you and the relevant finance provider.

We can arrange transport and delivery of machinery within the UK, across Europe, and worldwide through third-party logistics providers. Delivery costs will be quoted separately and are not included in the purchase price unless expressly stated.

Delivery times are estimates only and are not guaranteed. We shall not be liable for any delay in delivery caused by circumstances beyond our reasonable control, including but not limited to adverse weather, transport disruptions, or third-party logistics delays.

Risk of damage to or loss of the Goods passes to you upon delivery (or upon collection if you arrange your own transport). Title to the Goods passes to you only upon receipt of full payment.

All machinery is sold as used equipment. We inspect machines to the best of our ability and endeavour to provide accurate descriptions, but we do not guarantee that any machine is free from defects, faults, or wear and tear consistent with its age and usage.

Business buyers: Goods are sold “as seen” unless otherwise agreed in writing. To the fullest extent permitted by law, all implied warranties, conditions, and other terms (including those implied by the Sale of Goods Act 1979 or the Supply of Goods and Services Act 1982) are excluded.

Consumer buyers: Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms. Goods must be of satisfactory quality, fit for purpose, and as described, taking into account their age, price, and condition as used equipment.

If you are a consumer purchasing Goods at a distance (i.e. without face-to-face contact), you may have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. In such cases, you have 14 days from the date of delivery to notify us of your decision to cancel.

Due to the nature and size of heavy machinery, the practicalities of exercising a cancellation right (including return transport) will be discussed and agreed on a case-by-case basis. You may be responsible for the cost of returning the Goods.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Subject to the above, and to the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of business, loss of revenue, or loss of anticipated savings
• Our total liability to you in respect of all losses arising under or in connection with a contract shall not exceed the price paid for the relevant Goods
• We accept no liability for any inaccuracies or omissions in the content of this Website
